Terms & Conditions

[TD Synnex] incentive scheme is about recognising and rewarding [PARTNERS] who deliver the best results. 

ELIGIBILITY 

This scheme is open to UK [PARTNERS] who reside in the UK, who are 18 years of age or older at the time of entry and who have agreed to participate in the Incentive Scheme and who have agreed to performance related points for the duration of the Incentive Scheme. 

TO PARTICIPATE 

To participate in the scheme and to remain a Participant in the incentive scheme, [PARTNERS] must: 

Accept the Terms and Conditions of the incentive scheme on first log-in to the Incentive Scheme website. 

For the avoidance of doubt, [TD Synnex] shall have no liability to [PARTNERS] where, for whatever reason, they leave the employment of their [PARTNERS]. In such circumstances [TD Synnex] shall suspend such [PARTNERS]’s account. [TD Synnex] will however permit the user to utilise any points accrued up to that time in accordance with the terms of the incentive scheme until month close. 

It is the [PARTNERS] responsibility to keep passwords and username details secret. [TD Synnex] shall accept no responsibility for any loss suffered by the [PARTNER] where such loss is attributed to a failure by a [PARTNER] to maintain account security. 

[TD Synnex] will announce the activities and targets that [PARTNERS] are required to achieve to earn points. 

These activities and targets may vary by product/resource. 

TIMING 

The scheme runs from [20th June 2024] and, unless otherwise stipulated, will be on-going. 

Participation in the Incentive Scheme constitutes full and unconditional acceptance of these Terms and Conditions. [TD Synnex] reserves the right to disqualify anyone in breach of these terms and conditions. 

USE OF DATA 

Personal data which you provide will be shared with Motivates Ltd to fulfil the rewards and will not be used for any other purpose unless agreed. It may be used for programme communications and for the purpose of the [PARTNER] Incentive programme only. 

POINTS 

Once a claim has been submitted it will be reviewed every two weeks and approved or declined.  

AWARDING POINTS 

Points will be awarded to the [PARTNER] once a claim has been approved at the end of the week. 

Points will only be awarded to the [PARTNER] once they have submitted their claim with all the correct details. 

[TD Synnex] reserves the rights to increase or decrease points awarded through the incentive scheme without notice. 

The claim must be submitted by the end of each month in order for the correct points to be awarded. 

[TD Synnex] reserves the right to increase or decrease time allocated to claim bookings through the scheme. 

REDEEMING POINTS 

Points must be redeemed via the website. Prizes once chosen can only be changed if the redeemer contacts within 24 hours of the redemption. 

Substitution 

In case of a reward item not being available, we will contact the user within 7 days of placing the order and offer a replacement item of similar value. If the user does not wish to accept the replacement item, the original value of the reward deducted from the user’s account will be re-credited. 

Motivates Limited Inc reserves the right to substitute prizes of equal or similar value. 

Motivates ​Limited Inc reserves the right to remove or include any reward from the range at our discretion. 

Motivates ​Limited Inc will honour any rewards that have already been allocated a [PARTNER] prior to any website alterations. 

Delivery 

The delivery of Lifestyle gift cards will be via an instant e-voucher, and will be made to the email address as supplied by the user at the time of order. 

Validity 

Lifestyle vouchers are valid for two years from date of purchase. The exact expiry date will be printed on the e-voucher or advised upon successful activation. You must use the voucher before this expiry date or it will no longer be valid. 

Returns 

The [PARTNER] acknowledges that lifestyle vouchers are not returnable and non-refundable 

Tax and National Insurance 

Prizes and rewards are considered a taxable benefit to the recipients. While [TD Synnex] will cover the National Insurance on this award, it remains taxable in the hands of the individual. Therefore, you will have an income tax liability which remains your responsibility. 

OTHER 

Prizes and rewards may be considered a taxable benefit to the recipients. [TD Synnex] may agree to pay the tax liability and National Insurance contributions arsing on behalf of the [PARTNER]. Where it does not, recipients will be informed and will be directly responsible for accounting for and paying to their local tax offices any tax liability and NI contributions arising on their prize. Motivates ​Limited Inc will not account for any social or National Insurance or tax liability arising from this promotion. 

[TD Synnex] and Motivates ​Limited Inc will absolve themselves from any liability arising from any National Insurance contributions arising from this prize. 

No correspondence will be entered into regarding either this scheme or these Terms and Conditions. In the unlikely event of a dispute, [TD Synnex]’s decision is final. [TD Synnex] and/or Motivates ​Limited Inc reserve the right to amend, modify, cancel or withdraw this scheme at any time without notice. 

[TD Synnex] and/or Motivates ​Limited Inc cannot guarantee the performance of any third party and shall not be liable for any act or default by a third party. [PARTNERS] in this incentive scheme agree that [TD Synnex] and Motivates ​Limited Inc will have no liability whatsoever for any injuries, losses, costs, damage or disappointment of any kind resulting in whole or in part, directly or indirectly from acceptance, misuse or use of a prize, or from participation in this promotion. Nothing in this clause shall limit [TD Synnex] or Motivates ​Limited Inc liability in respect of death or personal injury arising out of its own negligence or arising out of fraud. 

[TD Synnex] or Motivates ​Limited Inc reserves the right in its sole discretion to cancel or suspend the redemption programme. 

Data Protection 

Motivates ​Limited Inc complies with each of the eight principles of the Data Protection Act 1998. Those principles require that data is: 

  • fairly and lawfully processed 

  • processed for limited purposes 

  • adequate, relevant and not excessive 

  • accurate 

  • not kept longer than necessary 

  • processed in accordance with the data subject’s rights 

  • secure 

  • not transferred outside the EU without adequate protection 

The text, illustrations and images used in all Motivates ​Limited Inc promotional materials are protected by copyright and must not be copied in whole or in part without the express permission of Motivates ​Limited Inc.  

All the above terms and conditions apply as a condition of using any voucher, whether or not the voucher holder is the original purchaser. Motivates ​Limited Inc reserves the right to change these terms from time to time without reference to customers. These terms and conditions do not affect your statutory rights as a consumer, and are governed by and in accordance with English law. The purchaser and Motivates ​Limited Inc agree that any problems fall under the jurisdiction of the English courts.
